These terms apply to your use of shelfcheckai.com (the "site") and to free AI Shelf Reports requested through it. ShelfCheck is operated by Kai Andrade, a sole proprietor based in Massachusetts, USA ("ShelfCheck," "we," "us"). By using the site or requesting a report, you agree to these terms. If you don't agree, please don't use the site.
1. Our services
ShelfCheck tests how AI assistants such as ChatGPT, Gemini and Perplexity answer shopper questions, reports which brands they recommend, and suggests ways a brand could improve how it appears. The free AI Shelf Report is offered at no cost and with no obligation. Paid services, including the 30-day AI Shelf Pilot, are provided under a separate written agreement or order. If that agreement conflicts with these terms, the agreement controls.
2. Who can use the site
The site and our services are intended for businesses. By requesting a report, you confirm that you are at least 18, that you are requesting it for a business, and that the information you give us is accurate. If you request a report about a brand you don't work for, it must be for a lawful business purpose such as competitive research.
3. No guarantee of AI results
AI assistants are operated by other companies. We don't control them, their answers vary from one question to the next, and they change over time. Our reports and the AI Shelf Index describe what we observed during specific tests. They are not a prediction or guarantee of future AI answers, search rankings, traffic or sales. The only guarantee we offer is the money-back guarantee described in our Refund Policy and your pilot agreement.
4. Not affiliated with AI providers or brands
ShelfCheck is independent. We are not affiliated with, endorsed by or sponsored by OpenAI, Google, Perplexity or any brand named on the site or in our reports. Product and company names are trademarks of their respective owners and are used only to identify them. Brands shown in the AI Shelf Index are not ShelfCheck clients unless we say so.
5. Information and accuracy
We work to report our test results accurately, but reports and site content are provided for general business information. They are not legal, financial or professional advice. Please use your own judgment before making business decisions based on them.
6. Intellectual property
The site, the AI Shelf Index, our reports, text, design and logo belong to ShelfCheck. You may share links to the site and quote small parts of the AI Shelf Index with credit to ShelfCheck. When we send you a report, you may use it inside your business. Please don't resell or republish our reports or index as your own.
7. Acceptable use
Please don't misuse the site. That includes submitting false information or spam, trying to access systems you're not allowed to, interfering with the site's operation, or scraping it in bulk.
8. Links to other sites
The site links to other websites, such as our LinkedIn and X profiles and our sources. We are not responsible for their content or privacy practices.
9. Disclaimers
To the extent permitted by law, the site and free reports are provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
10. Limitation of liability
To the extent permitted by law, ShelfCheck will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site or our reports. Our total liability for any claim relating to the site or our services will not exceed the greater of the amount you paid us in the 12 months before the claim or US $100. Nothing in these terms limits liability that cannot be limited under applicable law.
11. Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Any dispute will be handled in the state or federal courts located in Massachusetts, unless the law requires otherwise.
12. Changes
We may update these terms from time to time. We will post the new version on this page and update the date at the top. Changes apply from that date and do not affect a paid agreement already in place.
